Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") govern access to and use of the DECODX website (decodx.app) and, at a summary level, the Design Partner Program described on this site (together, the "Services"), provided by DECODX ("DECODX," "we," "us"). By visiting the site, submitting a Design Partner Application, or otherwise using the Services, you agree to these Terms.
These Terms cover website use and the application process. A separate, more detailed Design Partner Agreement — covering scope of work, data processing, fees, payment schedule, confidentiality, and liability for an accepted engagement — is executed directly with each accepted Design Partner and governs that engagement; where the two conflict for an accepted partner, the signed Design Partner Agreement controls.
2. Eligibility and accounts
The Services are intended for business users evaluating or participating in the Design Partner Program on behalf of an organization. You must have authority to submit information on behalf of your organization when applying.
3. The Design Partner Program
The Design Partner Program is an application-based, limited-cohort engagement. Submitting an application does not guarantee acceptance. DECODX selects participants based on strategic fit, data availability, and leadership participation, at its sole discretion, and may close, pause, or change the program at any time.
Published program pricing (currently Founding, Growth, Enterprise, and Strategic tiers) reflects the fee structure at the time of application and is subject to change; the fee, scope, and payment schedule for an accepted engagement are fixed in the signed Design Partner Agreement. Where stated, the 25% Year-1 conversion credit, its cap, and its conditions (use within 90 days of program completion, forfeiture if the engagement ends early) apply only as described on the Pricing page and as confirmed in that agreement.
4. Acceptable use
You agree not to: misrepresent your identity or authority when applying; submit data you do not have the right to share; attempt to access another organization's data or bypass tenant isolation or access controls; interfere with or disrupt the integrity or performance of the Services; or use the Services to build a competing product.
5. Data and behavioral scores
Behavioral scores, predictions, and recommendations produced by the Services are probabilistic decision-support outputs, not certainties, psychological diagnoses, or definitive judgments about any individual. As described in our Responsible AI approach, consequential actions based on these outputs require human review. DECODX is not responsible for business decisions made without appropriate human review of a recommendation.
6. Intellectual property
The Services, including the website, the Behavioral Ontology, scoring methodology, and all related software and content, are owned by DECODX or its licensors and protected by intellectual property laws. "DECODX," "Behavioral Intelligence," "Behavioral Performance Index," and related marks are marks of DECODX. Nothing in these Terms grants you rights to our intellectual property except the limited right to view and use the public website and to submit an application.
7. Confidentiality
Information you submit through the Design Partner Application, and any non-public information exchanged during evaluation of your application, will be treated as confidential and used only to evaluate and administer the Design Partner Program, consistent with our Privacy Policy.
8. Disclaimers
The website and the information on it are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Synthetic-data product demonstrations shown on this site illustrate platform capability and do not represent guaranteed results for any Design Partner.
9. Limitation of liability
To the fullest extent permitted by law, DECODX will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the website or the application process. Liability arising from an accepted Design Partner engagement is governed exclusively by the signed Design Partner Agreement.
10. Termination
We may suspend or terminate your access to the website or withdraw a pending application at any time, for any reason, including a violation of these Terms.
11. Governing law
These Terms are governed by the laws applicable at DECODX's principal place of business, without regard to conflict-of-laws principles, except where applicable law requires otherwise.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
